Grievance Procedure Under the Americans with Disabilities Act

This Grievance Procedure is established to meet the requirements of the Americans with Disabilities Act of 1990 (” ADA”).  It may be used by anyone who wishes to file a complaint alleging discrimination on the basis of disability in the provision of services, activities, programs, or benefits of the Sterling Park District.

Complaints alleging discrimination on the basis of disability regarding employment matters are addressed in the Park District’s Personnel Policy Manual.

A complaint regarding services, activities, programs or benefits of the Sterling Park District should be in writing and contain information about the alleged discrimination such as name of complainant, address of complainant, phone number of complainant, the location, date, and a description of the issue. Alternative means of filing complaints, such as personal interviews or a tape recording of the complaint, will be made available for persons with disabilities upon request to the ADA Coordinator for the Sterling Park District.

The complaint should be submitted by the grievant and/or his/her designee as soon as possible but no later than 90 calendar days after the alleged violation to:

Within 15 business days after receipt of the complaint, Jana Jacobs or her designee will communicate or meet with the complainant to discuss the complaint and the possible resolutions. Within 15 business days of the meeting or the filing of the complaint, whichever is later, Jana Jacobs or her designee will respond in writing, and where appropriate, in a format accessible to the complainant, such as large print, Braille or audio tape. The response will explain the position of the Sterling Park District and offer options for prompt and substantive resolution of the complaint.

If the response by Jana Jacobs or her designee does not satisfactorily resolve the issue, the complainant and/or his/her designee may appeal the decision within 15 business days after receipt of the response to the Board Secretary of the Sterling Park District Board of Commissioners.

Within 35 business days after receipt of the appeal, the Board will meet to discuss the complaint and possible resolutions. Within 10 business days after the meeting, the Board will respond in writing, and, where appropriate, in a format accessible to the complainant, with a final resolution of the complaint. The decision of the Board may not be appealed and is final.

All written complaints received by Jana Jacobs or her designee, appeals to the Board, and responses will be retained by the Sterling Park District for at least three years.
